My wife and I purchased a Revocable Living Trust at the cost of $900.00 +. My wife passed away in January, 2020. I went to Upshur County Clerks office to record my wife’s Revocable Living Trust within the week of her passing. I asked the person at the desk if they could review the Revocable Living Trust? Their reply was “ Don’t hand that to me”. I was not informed why I should not hand that to them. The individual at the desk excused themselves to get another individual. When the other person arrived, I ask if they could review the Revocable Living Trust and what I needed to do and handed it to them. After they review the Revocable Living Trust, I was informed that it is not legal, because the Revocable Living Trust is not Notarized. The Revocable Living Trust is Notarized for all the Power of Attorney chapters at the beginning. I was not informed until after I handed the Revocable Living Trust to the County Clerks employee, that the Revocable Living Trust will not be returned. Once a Will is handed to an employee, it must be recorded and not returned, is what I was told. I then had to hire a lawyer to change the Revocable Living Trust into a will. Another $900.00+ recording fees. Had to change property Deeds from a Revocable Living Trust to a will. Another $150.00 plus $26.00 recording fees. The County Clerks Office needs to have empathy for the person who has lost a love one. Knowledge of Revocable Living Trusts. Bottom line, The Upshur County Clerk Office works for the citizens of Upshur County and their wages paid by the citizens.
